This is the working draft of our terms. By using KAN Pro Audio you agree to these terms. If you have questions, hit the contact form.
1. Who's who
KAN Samples ("we", "us", "our") operates KAN Pro Audio (the "Platform") at kanproaudio.com. You ("the producer") are anyone with a registered account. Visitors to public pages don't need an account but are still bound by the parts of these terms that apply to use of the site.
2. Account eligibility
- You must be at least 16 years old (or the age of digital consent in your country, whichever is higher).
- You provide accurate email + artist information.
- You keep your password to yourself. Activity logged from your account is treated as yours.
- One account per person. We may suspend duplicate accounts without notice.
3. Your music - who owns what
You retain full ownership of every track you upload. We never claim copyright, never sell your music, never use it outside the contexts described here.
By uploading a track, you grant KAN Samples a non-exclusive, royalty-free, worldwide licence to:
- Host the track and stream it from the Platform
- Display it on your profile, the relevant challenge page, the Hall of Fame, and the global feeds
- Generate and display branded share-kit assets (image cards, optional video) derived from the track
- Feature the track in promotional material for the relevant sample pack or challenge - emails, social posts, blog posts, KAN Samples' marketing site
This licence lasts as long as your account exists. If you delete your account or remove a specific track, the licence ends for that material. We will remove it from active surfaces; we cannot recall promotional material that was already published before deletion.
You confirm that the music you upload is yours to upload - that you own or control the rights to every sample, every collaborator's contribution, and every element in the track. If you sample a third party's recording, you're responsible for clearing that sample.
4. Acceptable use
You agree not to use the Platform to:
- Upload music that infringes someone else's copyright or moral rights.
- Upload audio with explicit hate speech, glorification of violence, or sexually explicit content involving minors.
- Harass, dox, or repeatedly mass-report other producers.
- Manipulate the leaderboard or like counts via bots, multi-accounts, or paid services.
- Reverse-engineer, scrape, or framebust the Platform.
- Re-upload a sample pack you bought from us as a track without producing something with it (the spirit of the challenges is making music, not redistributing the source files).
Breach of any of these can result in disqualification of submissions, suspension, or permanent removal of your account.
5. Sample packs and challenge rules
Each challenge is built around a specific KAN Samples sample pack. Buying the pack is not required to join the challenge, but it is required to make tracks that actually use the sounds. Submissions that obviously don't use the challenge pack may be disqualified at admin discretion. Disqualified submissions stay visible with a "DQ" badge but lose their accumulated likes and can no longer be liked.
6. Sample library subscription, credits, and top-ups
KAN Pro Audio Producer is a recurring monthly subscription that grants monthly subscription credits for use in the sample library. One credit = one first-party sample download (partner samples may cost more; the cost is displayed before you spend).
6.1 Billing and renewal
- Producer is priced at £12/month (GBP), billed via Stripe. Non-GBP customers see an approximate localised price; the actual charge is in GBP and your bank may apply an FX fee.
- The subscription renews automatically every month on the anniversary of your first successful payment. Renewal continues until you cancel.
- Failed payments are retried by Stripe over a few days. If retries continue to fail your subscription lapses.
6.2 How credits work
Credits come in two kinds, tracked separately:
- Subscription credits arrive with each successful monthly renewal. Unused subscription credits roll over month to month, capped at 200 credits total (twice the monthly allocation). Any monthly refresh that would push you above the cap is reduced to the cap — the excess is not carried forward.
- Purchased credits are one-off top-ups bought outside the monthly subscription. They have no cap and no expiry as long as your account remains open.
- When you download a sample, we spend subscription credits first, then purchased credits.
- Credit values are set by us and can change with reasonable notice. Existing purchased-credit balances honour the value they carried when purchased.
6.3 Cancellation and the 28-day grace window
- You can cancel at any time from the Billing page — no phone calls, no forms. Cancellation stops future renewals; you keep access to library downloads and any remaining credits through your current billing cycle.
- After cancellation, your subscription credits remain usable for a 28-day grace window. Resubscribing during the window preserves them. If you don't resubscribe, the subscription-credit balance is zeroed at the end of the window and cannot be restored.
- Your purchased credits are unaffected by cancellation. They remain on your account indefinitely and can be spent whenever you subscribe again.
- Downloads you have already made are yours forever. Every sample you have downloaded stays in your My downloads and can be re-downloaded free of charge, with or without an active subscription.
6.4 Refunds
- Credits that have been spent on a download (subscription or purchased) are non-refundable — the sound file has been delivered.
- Credits that have been granted but not yet spent are non-refundable outside statutory rights (see below).
- If you are a consumer in the UK, EU, or another jurisdiction with mandatory statutory rights, those rights are not affected by these terms. Where you have a right to a refund by law, we honour it.
- If a technical error on our end prevents you from downloading a sample you paid for, contact us via the contact form and we will restore the credit or the download.
6.5 Licence to use downloaded samples
- Each downloaded sample is licensed to you for use in your own music productions, commercial and non-commercial. This licence is worldwide, perpetual, and non-transferable.
- You may not redistribute the raw sample files, resell them, include them in another sample pack, or share your account so others can access downloads.
- If the sample is a partner sample (uploaded by an artist through our partner program) additional artist-specific terms may apply and will be shown at the point of download.
6.6 Changes to plans
We may change subscription pricing, monthly credit allocations, the rollover cap, or grace-window length with reasonable prior notice by email. You can cancel before any change takes effect. Continuing to hold the subscription after the change means you accept the new terms.
7. Prizes
Prizes are awarded at our discretion based on the rules and prize roster of each challenge. Prize fulfilment specifics:
- Physical prizes require you to confirm size / colour / customisation and provide a shipping address.
- Digital prizes are delivered via download links on your "My Prizes" page. Downloads are capped at 10 per grant; an admin can reset the cap on request.
- Prizes have no cash value and aren't transferable to another account.
- You can decline any prize. Declining is final.
- Prizes for finishes pending manual review are only granted after the review is approved.
8. Levels, XP, and the leaderboard
Levels, XP, and your leaderboard rank are cosmetic. They confer status and bragging rights, not legal entitlements. The formulas can change with notice. We may adjust an individual user's XP in cases of abuse (bot likes, multi-account farming) - see Acceptable Use.
9. Suspension and account closure
- You can close your account at any time via the contact form.
- We can suspend an account that violates these terms. Suspension revokes all active sessions and pauses prize fulfilment.
- For serious or repeat violations we can permanently remove an account. The producer loses access to the account and any unfulfilled prize grants.
10. Disclaimers
The Platform is provided "as is". We don't guarantee uninterrupted availability; we do operate it in good faith and respond to outages quickly. Audio files are served via short-lived signed URLs; expired URLs are not the same as deleted content.
11. Limitation of liability
To the maximum extent permitted by law, KAN Samples is not liable for indirect or consequential damages arising from use of the Platform - lost profits, lost music, lost streaming revenue, etc. Our maximum liability for any direct claim is capped at the value of any prize you've received from us in the prior 12 months, or USD 100, whichever is higher.
12. Governing law
These terms are governed by the laws of the jurisdiction in which KAN Samples is registered. Disputes go to those courts first - except either party may pursue small-claims-style remedies in their own jurisdiction where local law allows.
13. Changes to these terms
If we materially change these terms, we'll notify your account email and post an in-app notification at least 14 days before the change takes effect. Continuing to use the Platform after the effective date counts as accepting the new version.
